When Can You Get Divorced?
You can get a divorce in England & Wales if all of the following points are met:
- Married for over a year
- Relationship broken down
- Your married is legally recognised in the UK
Previously, you would also have to establish one of five facts to evidence breakdown of a marriage. However, the divorce process was reformed in April 2020, introducing some key changes. These changes include:
- A new minimum timeframe of 6 months to ensure a period of reflection and opportunity for agreement
- There is now no ability to contest or defend the decision to divorce
- You can now provide a statement of irretrievable breakdown, which doesn’t lay blame on either spouse, called a no-fault divorce
- Joint applications are now allowed
