When Can You Get Divorced?

You can get a divorce in England & Wales if all of the following points are met:

  • Married for over a year
  • Relationship broken down
  • Your married is legally recognised in the UK

Previously, you would also have to establish one of five facts to evidence breakdown of a marriage. However, the divorce process was reformed in April 2020, introducing some key changes. These changes include:

  • A new minimum timeframe of 6 months to ensure a period of reflection and opportunity for agreement
  • There is now no ability to contest or defend the decision to divorce
  • You can now provide a statement of irretrievable breakdown, which doesn’t lay blame on either spouse, called a no-fault divorce
  • Joint applications are now allowed

So, if you need help with a divorce, please contact us today.

Why Do I Need a Solicitor?

While some people may want to do a DIY divorce, it is always much safer and often recommended that you use a solicitor.

A divorce solicitor can help you with any complex matters or negotiations that may arise, and to make sure the paperwork is handled correctly. And, a solicitor can ensure your financial matters are resolved in order to prevent further claims between each other, such as a dispute over jointly owned property.

Even though you could handle your divorce yourself online, ultimately using a solicitor can save you time, money, and stress.

We can guide you through the process to the best possible outcome and help you deal with any snags along the way, all at an affordable rate. In fact, because we’re based in the North, our rates are typically lower than other solicitor’s rates further down south.

Breakups of Non-Married Couples

The financial rights that benefit married couples on divorce do not apply to non-married couples. So, if you jointly own property and you need advice on how to deal with that, we can help.

It’s incredibly important for you to have a friendly, expert solicitor on your side. We’re here to guide you through the process and help you take the right steps.
