The Food Standards Agency has recently reported that there are approximately 2.4 million cases of food poisoning per year in the United Kingdom. That is double the number of reported cases in 2009.
However, that is due to more sophisticated testing for foodborne illness, rather than the actual number of cases having increased. New techniques and studies have more reliably linked cases of gastroenteritis with foodborne pathogens.
These new studies have also been able to confirm the following:
- Nearly 400,000 norovirus cases are caused by food in the UK per year.
- Approximately 37% of food related norovirus cases are linked to dining out, 30% to lettuce sold in retail outlets, 26% to takeaways, 4% to raspberries and 3% to oysters sold in retail outlets.
- The updated foodborne norovirus estimate, together with the improved analysis of unknown illnesses approximate 2.4 million estimated UK cases of illness caused by infected food per year.
In the past Gastroenterologists have been reluctant to acknowledge that norovirus is spread by food in many cases, however, these studies clearly demonstrate that it is.
Also, with the continuing developments in science the causes of many unknown cases of gastroenteritis have been linked with food borne pathogens.
Making A Claim for Food Poisoning
You can claim compensation if you were infected by food and / or drink served by a restaurant, food outlet or hotel as part of an all-inclusive holiday package.
Where the illness was significant and a full recovery was not reached for 3 days or more, compensation is usually more than £1000. You can also claim financial loss such as loss of earnings and medical costs.
If you believe you have suffered from a case of food poisoning, you should consult your doctor to get confirmation when possible.
Claims are generally brought against commercial food retailers such as restaurants, take-aways, and grocery stores. These types of business will probably have insurance or the finance to pay your compensation if you do make a claim.
The aim of your claim will be to show you were sold infected food or drink. That will prove the retailer liable.
You will usually have 3 years from the onset date of your illness to bring a legal claim against the Defendant. So, providing you contact us before then you still have the legal right to pursue your claim.
